John Roberts
The AP is reporting that Bush will appoint John Roberts of the DC Circuit to the Supreme Court. I suspect this is an Administration strategy to float the most ultraconservative white dude they can find, knowing that he won't be confirmed. That way, they can retreat to someone less polarizing and yet adherent to the party line once the nom goes south. Any thoughts?

Just how ultraconservative is the guy? Can anyone point me to a decision he wrote that is far off into right field while on the D.C. circuit? After all, when he worked for his own firm he did have clients interests to represent, as each of us will have to. And why not a guy who has argued more than 35 times before the court? I would have preferred a more moderate choice, but oh well, the President wanted a legacy. The fun will be watching whether the "Gang of 14" will hold strong. I think that will be impossible, and after listening to Leheay and Schumer, it is going be to a long four or five months.
Good point Cowboyslaw, why isn't there a great deal of intellectual study and legislation on the forgotten amendment?

More the former than the latter, with some shades of Arlen Specter, particularly on the economic front.

On second thought, I agree: he's not that bad. In talking about it with some professors, they seem to think that Bush could have done a lot worse. (One of the more respected dems on the faculty even called Roberts "brilliant.") Having said that, the fact that Roberts' wife used to chair an organization called "Feminists for Life" gives me pause for thought.
On a related note, the Colorado Daily will run an article this week with some nomination commentary from CU Law students. It should make for an interesting read.
